Terms of service
Draft, pending legal review. Last updated 13 October 2026.
These terms are an agreement between you and Punchline Analytics [legal entity name and address to be confirmed] (“we”). They cover this website and the Punchline service: the dashboard, the API, the MCP server, the install packages, and the free agent traffic reveal. If you accept them for a company, you confirm you're allowed to, and “you” means that company.
Your account
- You sign in with an emailed link. Keep access to that email address secure; anyone who can read it can sign in as you.
- Site owners decide who else can see a site and what they can do. You're responsible for what people you invite, and the API keys and AI assistant connections you create, do with your account.
- Tell us straight away at hey@opsscale.co if you think someone has accessed your account without permission.
Plans and payment
- Plans and prices are on the pricing page. The Free plan costs nothing. Paid plans are billed in advance, monthly or yearly, through Stripe. Prices don't include taxes, which are added where they apply. [Jeff: Stripe Tax isn't switched on in checkout yet; decide before taking payments.]
- Paid plans renew automatically at the end of each monthly or yearly period, at the then-current price, until you cancel. We'll tell you at least [Counsel: number] days before a price change applies to you.
- Changing plans applies straight away. Stripe credits the unused part of the old plan against the new one, so an upgrade charges the difference and a downgrade leaves a credit for later invoices.
- Cancelling is done in Billing, under Manage billing. Your plan stays in place until the end of the period you've paid for, then your account moves to Free. Nothing is deleted when you cancel.
- Refunds: payments aren't refundable, including for unused parts of a period, except where the law requires it. [Jeff and Counsel: confirm the refund policy, for example a refund window for new yearly plans.]
- Going over your plan's page views doesn't stop anything and costs nothing extra. We'll email you, and may suggest a plan that fits. [Jeff: decide what happens with sustained overuse.]
- If a payment fails, Stripe retries it and your plan stays in place meanwhile. If it still can't be collected, your account may move to Free.
Your data
- The data Punchline collects on your websites, and your settings and reports, are yours. We use them only to provide the service to you, keep it secure, and support you. We don't sell them, and we don't use them to train AI models. [Counsel: decide whether to reserve the use of aggregated, de-identified statistics.]
- You're responsible for having the right to measure the websites you install Punchline on, and for telling their visitors, for example in your own privacy policy. Punchline is built to collect as little as possible (see the privacy page), and our privacy policy explains how we handle personal data. A data processing agreement is available on request.
- On paid plans you can export your data at any time through the API (Growth and up) or to your own data warehouse (Business). On any plan, you can ask us for a copy.
- If your account is closed, we delete your sites' data within [Jeff: number] days, unless the law requires us to keep something. [Jeff: confirm the deletion window.]
Acceptable use
Don't use Punchline to:
- measure a website you don't own or aren't authorised to measure, including through the free reveal;
- try to identify individual visitors, or combine Punchline data with other data to do so;
- send Punchline personal data it isn't designed for, such as form contents, passwords or payment details;
- break the law, or anyone else's rights;
- get around plan limits, rate limits or security controls, or access accounts or systems you aren't allowed to;
- overload, disrupt, probe or reverse engineer the service, except as the law allows. If you find a security issue, please tell us at hey@opsscale.co.
AI agents are welcome to read this website: plain-text versions of our pages are listed in llms.txt.
Suspension and closing an account
- You can stop using Punchline at any time. To close your account, email us. [Jeff: add self-serve closing to the roadmap.]
- We may suspend or close an account that breaks these terms or puts the service or other customers at risk. Where we reasonably can, we'll tell you first and give you a chance to fix it. If we close a paid account for reasons other than a breach of these terms, we'll refund the unused part of the period.
- We may change or stop offering features. If we stop the service entirely, we'll give at least [Counsel: number] days' notice so you can export your data.
Beta features
Features marked beta, like outcome reporting, may change or be removed, and are provided without any commitment about how they work.
No warranty
Punchline and this website are provided as they are. We work to keep them available and accurate, but we don't guarantee they'll be uninterrupted or error-free. Labels for agents and other visitors are evidence-based estimates, and each comes with the evidence behind it; they aren't guaranteed to be right in every case.
Liability
To the extent the law allows, we aren't liable for indirect or consequential losses, or for lost profits, revenue or data, and our total liability is limited to what you paid us in the 12 months before the claim. [Counsel: confirm the limitation and exclusions, and whether to add indemnities.]
Changes to these terms
We may update these terms. We'll change the date at the top, and email account owners at least [Counsel: number] days before a material change takes effect. If you keep using Punchline after that, the new terms apply.
General
These terms are governed by the laws of [Counsel: jurisdiction]. If part of them can't be enforced, the rest still applies. [Counsel: add dispute resolution, assignment and entire-agreement terms as needed.]
